Liability Waiver, Assumption of Risk & Release Agreement

Mohr Performance LLC | SparkQB

Effective Date: November 3, 2026

1. Agreement and Scope of Participation

This Liability Waiver, Assumption of Risk & Release Agreement ("Agreement") applies to participation in training, instruction, coaching, athletic development, and related activities offered, operated, or organized by Mohr Performance LLC, operating under the SparkQB brand (collectively referred to as "SparkQB," "we," "us," or "our").

This Agreement applies to all SparkQB programs and services, including, but not limited to:

  • Private and small-group quarterback training
  • Camps, clinics, combines, showcases, and specialty training events
  • Quarterback retreats, Pro Day preparation, and draft preparation
  • Remote coaching, virtual instruction, film analysis, and biomechanics assessments
  • Training programs, prescribed drills, and independent workouts
  • Training involving receivers, catchers, or other participating athletes
  • Training conducted in Oregon, Washington, or any other state or location
  • Programs involving athletes who travel to participate in SparkQB training
  • Programs involving SparkQB coaches traveling to athletes, teams, schools, or other locations
  • Activities conducted at schools, athletic fields, public parks, private facilities, or other training locations

This Agreement applies whether services are delivered in person, remotely, individually, or in a group setting.

2. Acknowledgment and Assumption of Risk

I understand that football training, athletic conditioning, throwing mechanics instruction, and related physical activities involve inherent and foreseeable risks.

These risks include, but are not limited to:

  • Muscle strains, ligament sprains, and joint injuries
  • Shoulder, elbow, wrist, back, hip, knee, and ankle injuries
  • Overuse injuries and injuries associated with repetitive throwing
  • Falls, collisions, contact with other participants, and impacts from footballs or training equipment
  • Concussions, head injuries, and other traumatic injuries
  • Dehydration, heat exhaustion, heatstroke, and other weather-related conditions
  • Cardiovascular complications, fainting, or other medical emergencies
  • Injuries resulting from uneven surfaces, field conditions, or equipment
  • Serious bodily injury, permanent disability, or death

I understand that injuries may occur even when reasonable precautions are taken and appropriate coaching techniques are used.

I voluntarily choose to participate, or authorize the minor athlete identified below to participate, with knowledge of these risks.

I accept the inherent risks of participation and agree to exercise reasonable care, follow safety instructions, and communicate any condition that may affect safe participation.

3. Physical Readiness and Medical Conditions

I represent that the participant is physically capable of participating in the selected activities or has obtained appropriate medical clearance.

I understand that SparkQB does not perform a comprehensive medical evaluation before participation.

I agree to disclose relevant injuries, physical limitations, medical restrictions, or other conditions that could materially affect the participant's safety.

Participants are responsible for stopping activity and notifying a coach if they experience pain, dizziness, unusual fatigue, breathing difficulties, or other concerning symptoms.

SparkQB may modify, suspend, or discontinue participation when its coaches reasonably believe continued activity presents a safety concern.

4. Release of Liability

PLEASE READ CAREFULLY. THIS SECTION AFFECTS IMPORTANT LEGAL RIGHTS.

To the fullest extent permitted by applicable law, I, on behalf of myself and, where legally permitted, my heirs, estate, representatives, and assigns, release Mohr Performance LLC, SparkQB, and their respective owners, members, managers, officers, employees, coaches, independent contractors, agents, representatives, and affiliated training personnel (collectively, the "Released Parties") from claims arising from injuries, illness, death, or property damage connected with participation in SparkQB activities.

This release is intended to include claims arising from the ordinary negligence of the Released Parties, but only to the extent such claims may lawfully be released under the applicable jurisdiction's laws.

This release does not apply to gross negligence, reckless conduct, intentional misconduct, or any other claim or liability that cannot legally be waived.

Nothing in this Agreement is intended to eliminate a legal duty or right that cannot lawfully be excluded or limited.

5. In-Person Training and Training Locations

I understand that SparkQB may conduct training at facilities or locations it does not own, operate, inspect, or control.

These locations may include school fields, public parks, privately owned facilities, and other athletic environments.

I acknowledge that playing surfaces, weather, equipment, and other participants may introduce additional risks.

I agree to follow posted facility rules, applicable laws, and reasonable instructions provided by SparkQB personnel.

I understand that training may be modified, delayed, relocated, or canceled when conditions are considered unsafe.

6. Remote Coaching and Independent Training

I understand that remote coaching, virtual instruction, video analysis, and prescribed training programs may require the participant to perform physical activities without a SparkQB coach physically present.

SparkQB cannot directly supervise the participant's environment, equipment, execution, or physical condition during independently performed activities.

I acknowledge that:

  • Remote instruction does not replace in-person supervision when supervision is necessary.
  • Participants are responsible for selecting reasonably safe training environments and appropriate equipment.
  • Minors must have appropriate adult supervision when performing activities that require it.
  • Training recommendations should be modified or discontinued if they cause pain or create an unsafe condition.
  • Biomechanics assessments and performance analysis are intended for athletic development, not medical diagnosis or treatment.

I voluntarily assume the inherent risks associated with independently performed training.

The release and limitations described in this Agreement apply to remote activities to the extent permitted by applicable law.

7. Travel, Destination Training, and Off-Site Coaching

I understand that SparkQB provides training services at various locations throughout the United States and may provide services internationally.

These services may include:

  • Athletes traveling to SparkQB coaches for private training, camps, clinics, or other programs.
  • SparkQB coaches traveling to an athlete's city, school, training facility, or other designated location.
  • Training hosted by schools, athletic organizations, teams, or third-party facilities.
  • Private and group training conducted at temporary or independently operated locations.
  • Training arranged as part of camps, showcases, consulting engagements, or special events.

I acknowledge that training may occur at facilities not owned, operated, or controlled by SparkQB.

Unless otherwise agreed in writing, participants are responsible for their own transportation, lodging, meals, and personal activities outside scheduled training.

When SparkQB travels to provide training, I understand that the host facility or location may have its own rules, conditions, and risks.

SparkQB is not responsible for the independent acts or omissions of airlines, hotels, transportation providers, or other third parties it does not control, except where liability cannot lawfully be excluded.

I voluntarily assume the inherent risks associated with participation at these locations.

The liability release and other provisions of this Agreement apply to covered SparkQB activities regardless of where they occur, to the fullest extent permitted by the law applicable to the particular activity or claim.

Nothing in this Agreement is intended to waive rights or claims that cannot lawfully be waived.

8. Receivers, Catchers, and Additional Participants

I understand that receivers, catchers, and other individuals participating in SparkQB training may be exposed to physical risks, even if they are not paying customers.

Any individual actively participating in throwing, catching, running routes, drills, or other physical activities must complete an applicable participation waiver before participating.

A waiver completed by a quarterback does not automatically cover a separate receiver, catcher, or other participant.

All participants, regardless of whether they pay for training, are subject to applicable safety instructions and participation requirements.

9. Parent or Legal Guardian Consent

If the participant is under 18 years of age, this Agreement must be reviewed and completed by a parent or legal guardian.

As the parent or legal guardian, I:

  • Authorize the minor athlete to participate in the selected SparkQB activities.
  • Acknowledge that I understand the risks associated with participation.
  • Confirm that I have authority to provide consent for the minor's participation.
  • Agree to communicate relevant medical restrictions and safety concerns.
  • Accept the responsibilities expressly assigned to parents or guardians under this Agreement.

To the extent permitted by applicable law, I also agree to the release of my own individual claims arising from the minor's participation.

Nothing in this Agreement is intended to waive a minor's independent legal claims where such a waiver is prohibited or unenforceable under applicable law.

10. Emergency Medical Treatment

In the event of an injury or medical emergency during an in-person SparkQB activity, I authorize SparkQB personnel to contact emergency medical services and, when reasonably necessary, assist in obtaining emergency care.

For minor participants, the parent or legal guardian authorizes reasonable efforts to obtain emergency assistance when immediate parental contact is unavailable.

I understand that SparkQB personnel may not be medical providers acting in a clinical capacity during training.

I acknowledge that the participant or responsible parent or guardian is responsible for medical expenses incurred, subject to applicable law and any legally responsible party's obligations.

This authorization does not require SparkQB to provide medical treatment beyond the training personnel's qualifications.

11. Personal Property

Participants are responsible for their personal belongings, including footballs, clothing, electronic devices, and other equipment.

To the extent permitted by law, SparkQB is not responsible for loss, theft, or damage to personal property except where liability cannot lawfully be excluded.

12. Video Recording and Performance Analysis

I understand that SparkQB may record training sessions or receive participant-submitted videos for coaching, biomechanics analysis, performance assessment, and athlete development.

I authorize SparkQB to use recordings and submitted footage internally for these purposes and to share them with the participant, parent or guardian, and authorized coaching personnel as reasonably necessary to deliver the requested services.

This may include the use of video analysis software, biomechanics assessment platforms, and other technology utilized by SparkQB, including SpinLabAi.

Public use of identifiable photographs, videos, testimonials, names, or likenesses for marketing, advertising, or social media requires separate authorization.

I understand that participating in training does not automatically grant SparkQB permission to use my likeness publicly for promotional purposes.

13. No Guarantee of Athletic Results

I understand that athletic development depends on numerous factors, including individual ability, physical condition, consistency, effort, and circumstances outside SparkQB's control.

SparkQB does not guarantee specific performance improvements, throwing velocity, recruitment opportunities, scholarships, roster positions, or professional athletic outcomes.

Training recommendations and performance assessments are provided for educational and athletic development purposes.

14. Compliance With Instructions

Participants agree to follow reasonable coaching instructions, use equipment appropriately, respect other participants, and avoid conduct that creates unnecessary risk.

SparkQB reserves the right to remove or suspend a participant whose conduct presents a safety concern or materially interferes with training.

15. Applicable Law and Severability

This Agreement shall be interpreted under applicable law, including any mandatory legal protections governing the participant or the location where the relevant activities occur.

The enforceability of any release, limitation, or other provision shall be determined under the law applicable to the particular claim.

If any provision is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the extent legally permissible.

Nothing in this Agreement requires a participant to surrender legal rights that cannot lawfully be waived.

16. Duration of Agreement

This Agreement applies to SparkQB activities occurring after its acceptance and remains in effect for twelve (12) months from the date of acceptance, unless replaced by a newer agreement or terminated in writing.

Participants may be required to complete an updated waiver when enrolling in a new program, attending a special event, or participating in training in another jurisdiction.

Termination does not retroactively affect rights or obligations arising from activities that occurred while the Agreement was in effect, subject to applicable law.

17. Acknowledgment and Voluntary Acceptance

BY SIGNING OR ELECTRONICALLY ACCEPTING THIS AGREEMENT, I ACKNOWLEDGE THAT:

  1. I have read and understand this Agreement.
  2. I understand that football training and athletic activities involve risks of serious injury or death.
  3. I voluntarily accept the inherent risks associated with participation.
  4. I understand that this Agreement contains a release of certain legal claims, including claims involving ordinary negligence where legally enforceable.
  5. I understand that certain rights and claims cannot legally be waived.
  6. I am signing voluntarily and have had an opportunity to review the Agreement and ask questions before accepting it.
  7. If signing for a minor, I am the minor's parent or legal guardian and have authority to consent to participation.
